Terms of service

Applies to website access, accounts, product use, purchases, previews, and Engineering Services.

1. Agreement and scope

These terms govern your use of the Gamibase website, accounts, downloads, product clients, purchases, early-access programs, and public Engineering Services qualification process. By using those surfaces, you agree to these terms. A checkout, order, offer-specific addendum, statement of work, data-processing agreement, or other accepted written agreement may add terms for a particular product or engagement. Where it expressly conflicts with these general terms, that more specific agreement controls for its stated subject.

2. Eligibility and accounts

You must be legally able to enter this agreement. If you use Gamibase for an organization, you represent that you are authorized to bind that organization and authorize the project access and operations you request. Provide accurate account information and protect your sessions, devices, and provider credentials. You may not share access outside the rights granted by your current entitlement. We may require reauthentication or block access when account, entitlement, device, policy, or security evidence is invalid, stale, revoked, or unavailable.

3. Product access and license

Subject to these terms and your applicable order, Gamibase grants you a limited, non-exclusive, non-transferable, and non-sublicensable right to use the applicable software and documentation for their intended purpose. The current product catalogue and accepted order define the eligible release, term, users, devices, upgrade rights, and any offline use. No right is granted to resell, redistribute, sublicense, publicly host, bypass access controls, remove proprietary notices, or reverse engineer except where applicable law does not permit that restriction. Open-source and third-party components remain governed by their own licences.

4. Customer projects and content

You retain ownership of your pre-existing project source, assets, prompts, captures, documentation, and other customer material. You authorize Gamibase and the providers used for your requested operation only to process the material reasonably necessary to provide that operation, support request, or written engagement. You represent that you have the required rights and authority. Do not submit credentials, proprietary source, private assets, or sensitive logs through a public form. Confidentiality, project access, retention, deletion, and ownership of Services deliverables are governed by the applicable written engagement.

5. External providers and generated output

Gamibase may route an authorized operation through a configured AI, worker, asset, speech, vision, or other provider. The route may use a Gamibase entitlement, your locally authenticated provider account, or another explicitly configured credential and billing arrangement. By approving that route, you authorize the selected request data to be sent to the provider. You are responsible for the provider account, provider terms, charges, content permissions, and configuration you supply. Provider output can be inaccurate, incomplete, non-unique, unsuitable, or subject to third-party rights. Review outputs, licences, provenance, attribution, and commercial-use limits before relying on or distributing them. Gamibase does not guarantee output accuracy, originality, non-infringement, or commercial clearance.

6. Local execution, evidence, and recovery

Authorized product operations may read files, start local processes, call engine or tool adapters, create outputs, or modify project state through sanctioned routes. Maintain appropriate backups and version control, inspect plans and diffs, and confirm operations before execution. Availability depends on current project, engine, platform, configuration, entitlement, authority, and evidence. A completed command, read-back result, receipt, or proof establishes only the checks it records; it does not prove every side effect, creative quality, production readiness, or commercial suitability. Recovery and reversal are not universal. Where supported, a reverse action is a new governed operation against the project's current state and may be blocked, fail, or be declared unsupported.

7. Engineering Services

Submitting a Services request is a qualification inquiry, not a quote, diagnosis, engagement, or promise of delivery. Engineering work begins only under an accepted written scope defining the supported project boundary, deliverables, exclusions, acceptance checks, fees, access, customer responsibilities, confidentiality, intellectual-property treatment, handoff, and change process. A diagnostic engagement provides the agreed findings and remediation plan; implementation or repair is included only when the written scope says so. Co-development is bounded to the agreed outcome, and work outside that boundary requires a separately accepted change. Gamibase does not guarantee that a project will ship, pass platform certification, achieve commercial success, or become production-ready unless a specific measurable obligation is included in the written scope.

8. Preview and early access

Gamibase Studio and identified preview capabilities are proprietary pre-release technology in active development. Early-access registration does not guarantee admission, a download, a release date, continued access, feature availability, compatibility, support, or production suitability. Preview features may change, be limited, fail closed, or be withdrawn. Mockups, fixtures, sample projects, captures, screenshots, and illustrative evidence are not proof that a capability is generally available for your project.

9. Purchases, subscriptions, and entitlements

The price, billing interval, renewal behavior, taxes, cancellation timing, refund terms, seat or device limits, and entitlement scope shown in the applicable checkout or accepted order govern that purchase. Payments are handled by the designated payment provider. You authorize the charges shown when you complete checkout and must maintain valid billing information. A failed payment, refund, cancellation, chargeback, suspected fraud, or invalid entitlement may change or revoke the associated access according to the accepted order and applicable law. Cancellation prevents future renewal as stated in the order terms; it does not automatically create a refund.

10. One-time and Founder offers

A one-time, Founder, perpetual, or offline-capable offer is governed by the versioned order accepted with that purchase. That order defines the eligible release, named-user rights, device limit, artifact delivery, upgrade window, refund window, transfer rules, and exclusions. A one-time product licence does not include separate Studio access, Engineering Services, hosted features, future editions, or future releases unless the order expressly says so. A later revision of these general terms does not silently replace previously accepted order-specific rights.

11. Acceptable use

You may not use Gamibase unlawfully; infringe another person's rights; submit material you lack authority to process; send credentials or confidential project material through public forms; probe, disrupt, overload, scrape, or attack the Services; introduce malware; attempt unauthorized access or exfiltration; bypass account, entitlement, provider, engine, approval, policy, evidence, payment, seat, or device controls; misrepresent preview evidence as production proof; scrape restricted sources; violate source licences or attribution duties; or authorize automated project changes without appropriate authority and review.

12. Third-party services and engines

Identity, payment, hosting, engine, platform, AI, asset, repository, and other third-party services are governed by their own terms and policies. Gamibase does not control their availability, prices, licensing decisions, retention practices, compatibility, or service changes. Engine and operation availability is policy- and evidence-dependent; unsupported or stale state may be blocked instead of treated as successful. You are responsible for complying with third-party licences and platform rules that apply to your project and outputs.

13. Privacy

The Gamibase privacy policy explains how website, account, Services, local product, provider, billing, capture, and telemetry information is handled. Use of a relevant surface is subject to that policy and to any contextual notice shown before information is transferred to a provider. An authorized provider operation sends the selected payload described for that route.

14. Suspension and termination

We may suspend or terminate access for breach, abuse, security risk, legal requirement, non-payment, payment reversal, invalid entitlement, or material risk to a project or system. You may stop using a service and may cancel a subscription through the available account or billing path. On termination, access and paid entitlements end as stated in the applicable order. Terms concerning accrued payment, intellectual property, confidentiality, disclaimers, liability, disputes, and other provisions intended by their nature to survive remain effective.

15. Availability, warranties, and liability

Except for obligations expressly stated in an accepted written engagement and rights that cannot legally be excluded, the website, previews, software, and related services are provided as available. Gamibase does not promise uninterrupted operation, error-free output, universal compatibility, permanent feature availability, successful builds or packaging, complete recovery, commercial results, or fitness for a particular purpose. Nothing in these terms excludes a right or liability that applicable law does not allow the parties to exclude. Additional warranty or liability terms in an accepted order or written engagement apply to that purchase or engagement.

16. Changes and contact

We may update these general terms when products, offers, providers, or legal obligations change. Material changes will be communicated when required, and order-specific rights remain governed by the version accepted with that order. If part of these terms cannot be enforced, the remaining terms continue to apply. Questions about these terms, an account, billing, or commercial access can be submitted through the service request page. Do not include credentials, project files, or sensitive logs in a public request.
